RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT

I, the participant, (“Releasor/Participant”), understand that in participating in breathwork sessions, coaching sessions, breathwork trainings, immersions and intensives, video(s), and audio(s) and any related consultations online or in-person, (collectively referred to as “Activities”) offered by Suki Humby of Breathe With Suki (“Releasees/Facilitator”), I agree to the following:

SERVICES & DISCLOSURE.

I understand that breathwork and ‘’Activities’’ offered by Releasees are designed and intended to improve quality of life and assist holistic wellbeing and are not intended to replace medical advice or treatment. The Releasees / Facilitator are not, under any circumstances, a substitute for consulting your GP or medical advisor or related licensed professionals for diagnosis or treatment in relation to any health problem.

MEDICAL DISCLAIMER & CONTRAINDICATIONS.

I understand that breathwork and Activities may result in dramatic energetic, physical, mental, emotional releases, responses, and experiences. I understand that breathwork and the ‘’Activities’’ is not suitable and is not recommended for persons with a history of any kind of cardiovascular condition or disease, aneurysms, epilepsy or seizures, COPD or severe asthma, retinal detachment, glaucoma, very high or very low blood pressure and / or a history of fainting, recent surgery, osteoporosis, women who are pregnant and those who use prescription blood thinners.

• Epilepsy, strokes, seizures, or other neurological conditions
• Heart conditions / irregularities including prior heart attack
• Detached Retina or glaucoma
• Severe osteoporosis
• High Blood Pressure or very low blood pressure with fainting history  
• Pre-existing lung disease
• Previous Aneurysm and use of prescription blood thinning medications  
• Prior diagnosis by a health professional of bipolar disorder, schizophrenia or psychosis
• Severe PTSD / active strong symptoms
• Recent major surgery
• Pregnancy

I understand that Breathwork and the ‘’Activities’’ is not suitable and is not recommended for persons with mental illnesses including but not limited to bipolar disorder, schizophrenia, dissociative disorders, psychosis or for persons using antipsychotic medications. Persons with asthma are advised against practicing until they consult with their primary care physician and advise us in advance.

I hereby state that I am not pregnant, and if any of the above conditions apply to me, I will inform the Facilitator prior to participation. I understand that the Facilitator

is not qualified to evaluate my medical suitability to partake in the ‘’Activities’’, and that even though I may be accepted as a participant, I am responsible for any consequence, medical or otherwise, resulting from Breathwork or ‘‘Activities’’.

I hereby state that I am physically and mentally fit to participate in Breathwork and ‘’Activities’’ and understand that it is solely my responsibility to seek professional support after ‘’Activities’’ if I feel unstable mentally, physically, or emotionally. I knowingly waive any claim I may have against the Releasees for injury or damages that I may sustain as a result of participating in ‘’Activities’’.

RISKS.

I understand and acknowledge that the ‘’Activities’’ in which I am participating in carry some inherent risks and that Facilitator cannot eliminate, alter, or control these inherent risks. “Risks” include, but are not limited to, any health conditions, inaccessibility to immediate medical attention, risks inherent in breathwork that include, but are not limited to, psychological distress and disorientation, hyperventilation, over-exertion, respiratory alkalosis, muscle spasms, chest pain, numbness, heart attack, death, and injury or death caused by negligence on the part of Participant or other people around Participant.

I hereby understand, accept, and assume the risk of injury or harm, and agree that my involvement in Activities is voluntary, and that I choose to participate in spite of any potential Risks.

CONFIDENTIALITY.

I understand that confidentiality is important in all breathwork sessions and ‘’Activities’’ so that all participants feel safe if they wish to share their experiences and be fully self-expressed during their breathing session.

To participate, I understand that it is not permitted to photograph, audio or video record any portion of the session or re use any of the content under any circumstances. I understand that It is a condition of participating in any breathwork or ‘’activities’’ that strong ethical standards and full confidentiality is a fundamental requirement of participation.

I understand that in voluntarily revealing any of my personal information in group ‘’Activities’’, rights of privacy and confidentiality are waived and cannot be guaranteed by the Releasees / Facilitator if there is imminent danger to yourself or others.

WARRANTIES, & OUTCOMES.

I understand that the Facilitator has made no guarantees as to the outcome of ‘’Activities’’, and that information and testimonials presented before, during, or after ‘’Activities’’ do not constitute a warranty of specific outcomes.

LIMITATION OF LIABILITY.

By participating in or purchasing of Breathe With Suki and Heal with Suki services and ‘’Activities’’, I agree that Facilitator will not be held liable for any damages resulting from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from participation in ‘’Activities’’ or use of materials provided.

INDEMNIFY & HOLD HARMLESS.

By accepting this document and agreeing to “Register,” ‘’Enrol,’’ “Purchase,” “Buy,” or any other phrase related to purchase or attendance, entering payment information, or otherwise enrolling, electronically, verbally, or otherwise in ‘’Activities’’, I, in my personal name and on behalf of my relatives, heirs, legal representatives, and assigns, agree at all times to release, indemnify and hold harmless Releasees, as well as their affiliates, employees, students, joint venture partners, successors, assignees, and licenses, as applicable, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to ‘’Activities’’. I knowingly and freely assume all risks, both known and unknown, even if arising from the negligence of the Releasees or others and assume full responsibility for my participation in ‘’Activities’’.
