Waiver | Terms & Conditions
RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT
I, the participant (“Participant”), understand that in participating in breathwork sessions, Kambo sessions, coaching, mentoring or therapy sessions, receiving bodywork or therapeutic touch, breathwork trainings, retreats, workshops, immersions, intensives, videos, audios, and any related consultations online or in-person (collectively referred to as “Activities”) offered by Suki Humby of PSY SOMA and Breathe With Suki (“Facilitator”), I agree to the following:
SERVICES & DISCLOSURE.
I understand that all Activities are designed to improve quality of life and holistic well-being and are not intended to replace medical advice or treatment. The Facilitator is not a substitute for consulting a GP or medical advisor for any health issues.
MEDICAL DISCLAIMER & CONTRAINDICATIONS.
I understand that Activities may result in significant energetic, physical, mental, and emotional responses. Activities are not suitable for persons under 18 or those with certain health conditions, including but not limited to:
- Cardiovascular conditions
- Aneurysms
- Epilepsy or seizures
- Severe asthma
- Retinal detachment or glaucoma
- High or very low blood pressure
- Recent surgery
- Osteoporosis
- Pregnancy
- Use of prescription blood thinners
- Mental illnesses (e.g., bipolar disorder, schizophrenia, psychosis)
- Severe PTSD
- Immune suppression for organ transplants
- Chemotherapy or radiotherapy (or within 8 weeks post-treatment)
A list of Contraindications is also provided at point of booking. I confirm I am not pregnant, and if any conditions apply, I will inform the Facilitator prior to participation. I acknowledge that I am responsible for any consequences resulting from Activities.
RISKS.
I understand that Activities carry inherent risks, including but not limited to any health conditions, inaccessibility to immediate medical attention, psychological distress and disorientation, hyperventilation, respiratory issues, muscle spasms and tetany, chest pain, heart attack, injury and death. My participation is voluntary, and I accept these risks.
CONFIDENTIALITY.
Confidentiality is essential in all group Activities to ensure a safe environment for sharing. Photography, audio, or video recording is prohibited in all settings whether group or one – to – one. Ethical standards and confidentiality are required, though privacy cannot be guaranteed if there is imminent danger to facilitators or others.
WARRANTIES, & OUTCOMES.
The Facilitator makes no guarantees regarding the outcome of Activities. Testimonials do not constitute a warranty of specific outcomes.
LIMITATION OF LIABILITY.
By participating in or purchasing services and Activities, I agree that the Facilitator will not be held liable for any damages or liability arising from participation.
INDEMNIFY & HOLD HARMLESS.
By enrolling in Activities, I, in my personal name and on behalf of my relatives, heirs, legal representatives, and assigns, agree at all times to release, indemnify, and hold harmless the Facilitator, their affiliates, employees, co-facilitators, assistants, students, joint venture partners, successors, assignees, and licensees, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to Activities. I knowingly and freely assume all risks, both known and unknown, even if arising from the negligence of the Facilitator or others and assume full responsibility for my participation.
INDEMNIFY & HOLD HARMLESS.
For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby irrevocably authorize the Facilitators and PSY SOMA and Breathe With Suki to use photographs and/or videos of myself and/or my property and authorize them and their assignees, licensees, legal representatives, and transferees to use and publish (with or without my name) photographs, pictures, portraits, or images in any and all forms and media, for the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic and digital form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by Breathe With Suki / PSY SOMA. I further waive all rights to review or approve any uses of the images, any written copy, or finished product. I am of full legal age and have read and fully understand the terms of this release. If I do not want to be in any of the photos or videos, I understand that I must inform the Facilitator in advance.
JURISDICTION.
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
